Employers are permitted to round an employee's starting and stopping time (for example, to the nearest fifteen minutes) only when the manner of computing working time averages out over a reasonable period of time so that an employee is fully compensated for all the time he or she actually worked.

However, many employers have timekeeping and attendance policies that ensure that most, or all, of the timeclock rounding is in the employer's favor.  For instance, many employers round time to the nearest fifteen minutes but have policies or practices that prohibit employees from clocking in more than 7 minutes before the start of their shift or more than 7 minutes after the end of the shift. Any employee who clocked in at 7:53 a.m. and clocked out at 4:07 p.m. would have worked 8.25 hours but would have been paid for only 8 hours.

Employers in many states also maintain rounding policies but penalize employees who clock in more than a few minutes late. Employers who use unfair rounding policies often end up withholding hundreds of dollars in wages per employee per year. If your employer is using timekeeping and attendance practices and policies which ensure that time clock entries predominantly round in the company's favor, you have rights.
